This is a plain-English draft and is being finalised with our solicitor ahead of launch. It explains how we intend to operate; the final wording will be published here before you can be charged.

Please read these terms and conditions carefully before using this site.

These terms tell you the rules for using our website winabundle.co.uk (our site).

We are the owner or licensee of all intellectual property rights in our site and the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and download extracts, of any page(s) for your personal use, and may draw the attention of others within your organisation to content on our site. You must not modify paper or digital copies of any materials you have printed or downloaded, and must not use any illustrations, photographs, video, audio or graphics separately from accompanying text. Our status (and that of any identified contributors) as authors must always be acknowledged. You must not use any part of the content for commercial purposes without a licence from us. If you breach these terms, your right to use our site ceases immediately and you must return or destroy any copies you have made.

User-generated content is not approved by us

Our site may include information and materials uploaded by other users, including posts to our social media accounts. This content has not been verified or approved by us, and the views expressed do not represent our views or values. Our responsibility for loss or damage suffered by you

We do not exclude or limit in any way our liability to you where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. Different limitations and exclusions apply to liability arising from the supply of products or services, or from entering our competitions, which are set out in our Competition Terms and Conditions. We only provide our site for domestic and private use; you agree not to use it for any commercial purpose, and we have no liability for any loss of profit, business, business interruption or business opportunity.

Uploading content to our site

Whenever you upload content, post to our social media accounts or contact other users, you must comply with the content standards in our Acceptable Use Policy. You warrant that any contribution complies with those standards and will be liable to us, and indemnify us, for any breach. Any content you upload is considered non-confidential and non-proprietary; you retain ownership but grant us the licence described below. We may disclose your identity to any third party claiming that content you posted infringes their rights, and may remove any posting that does not comply with our Acceptable Use Policy. You are solely responsible for securing and backing up your content.

Rights you are giving us to use material you upload

When you upload or post content to our site, you grant us a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display and perform that user-generated content. We may also share it, quote from it and use it to promote our site, products and services, particularly via social media.

We are not responsible for viruses and you must not introduce them

We do not guarantee that our site will be secure or free from bugs or viruses. You are responsible for configuring your technology to access our site and should use your own virus protection software. You must not misuse our site by knowingly introducing viruses or other harmful material, attempt to gain unauthorised access to our site or its servers, or attack our site via a denial-of-service attack. By breaching this provision you would commit a criminal offence under the Computer Misuse Act 1990; we will report any such breach to the relevant authorities and co-operate by disclosing your identity. In the event of such a breach, your right to use our site ceases immediately.

Rules about linking to our site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not suggest any form of association, approval or endorsement where none exists, link from any website that is not owned by you, frame our site on any other site, or link to any part of our site other than the home page. Which country’s laws apply to any disputes

These terms of use, their subject matter and their formation are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction.
